Next-generation WSV3 Tactical and WSV3 Studio V0 End User License Agreement © 2026 TempoQuest, Inc. Windham, New Hampshire, USA By installing, accessing, or using WSV3 Tactical/WSV3 Studio, you agree to the following terms. If you do not agree, do not install or use the software or data services. 1. Definitions Software: The WSV3 Tactical/WSV3 Studio applications and related binaries. Data Services: Any real-time, near-real-time, historical, processed, hosted, or redistributed data delivered by TempoQuest servers, whether paid or trial. User: The individual or entity using the Software or Data Services. Company: TempoQuest, Inc. Subscription Period / Billing Period: The paid period for which you are charged (e.g., monthly, annual, or other). Excluded Downtime: Scheduled maintenance, emergency maintenance, third-party outages (upstream providers, cloud/CDN/DNS), force majeure, data source outages, your network/ISP/VPN/firewall issues, misuse, or use outside supported configurations. Inaccessible / Inaccessibility: A failure of TempoQuest systems to authenticate or deliver Data Services to you when requested, excluding Excluded Downtime. Output: Any image, video, animation, loop, screenshot, capture, recording, rendering, visualization, or derived product produced by the Software from the Data Services. Attribution Mark: The WSV3 watermark rendered by the Software over its output. Output carries the Attribution Mark when the Mark is present, unaltered, and legible as rendered by the Software; Output from which the Mark has been removed, cropped out, obscured, or altered does not carry it. Marked Output: Output carrying the Attribution Mark. Unmarked Output: Output not carrying the Attribution Mark. Television Broadcast: Transmission of the Data Services or any Output as, or as part of, programming carried by an over-the-air television or radio station, cable system, satellite service, or IPTV service, including any use by a television station, network, or affiliate, and any syndication of such programming. A station's, network's, or affiliate's distribution of its programming over the internet is Television Broadcast, not excluded from it. Media License: A separate paid license from TempoQuest granting rights not conveyed by a subscription, offered in Creator, Professional, Network, and TV Broadcast levels. Audience: The number of followers or subscribers on the single largest channel, account, or outlet on which your Output appears, or for a website, its monthly unique visitors, in each case averaged over the trailing twelve months or the life of the channel, whichever is shorter. Audience is measured on the largest single channel and is not summed across platforms. 2. License Grant – Software The Software itself is provided free of charge and is licensed, not sold. You are granted a non-exclusive, non-transferable license to install and use the Software for lawful purposes, subject to this Agreement. Your use of the Data Services through the Software, and your rights in the Output the Software produces, are governed by Section 4 regardless of how the Software is used. 3. Ownership; Restrictions TempoQuest retains all right, title, and interest in and to the Software and Data Services, including all intellectual property rights. As between you and TempoQuest, Output embodies and is derived from TempoQuest's proprietary Data Services and the Software's rendering, and TempoQuest retains all intellectual property rights in Output. Your sole rights to use, publish, or distribute Output are those expressly granted in Section 4. Except as expressly permitted by this Agreement, you may not: (a) copy, reproduce, distribute, sell, lease, sublicense, or transfer the Software; (b) reverse engineer, decompile, disassemble, or attempt to derive source code; (c) bypass or circumvent access controls; (d) use the Software or Data Services to build or operate a competing product or service; (e) scrape, harvest, or bulk-download Data Services except as enabled by the Software’s normal operation; or (f) share credentials or access intended for a single user/seat with others. 4. Data Services License (Paid) Certain features of WSV3 Tactical/WSV3 Studio require a paid data license. A paid data license grants you access to TempoQuest-hosted Data Services only for the active subscription period and only as delivered. No ownership or rights to the underlying data, infrastructure, or processing methods are conveyed. Grant — internal use. You may use the Data Services for your own use and your organization’s internal use. Grant — Marked Output. You may publish, display, and distribute Marked Output by any means other than Television Broadcast, without further permission, payment, or notice to TempoQuest — on any platform, in any medium, in any quantity, and for any purpose, including advertising-supported, sponsored, subscription-funded, and otherwise revenue-generating purposes. TempoQuest imposes no revenue limit, audience limit, or commercial-use restriction on the publication of Marked Output other than the Television Broadcast requirement below. Reserved — Unmarked Output. You may generate Unmarked Output for your own use and your organization’s internal use. You may NOT publish, distribute, or otherwise make Unmarked Output available to any third party without a Media License at the level corresponding to your Audience under the schedule of levels, Audience thresholds, and prices published by TempoQuest at the point of sale (currently Creator, Professional, and Network, in ascending order of Audience). A Media License at the applicable level permits publication of Unmarked Output by any means other than Television Broadcast. Media License level; representation and true-up. Selecting a Media License level is your representation that your Audience is within that level. If your Audience grows beyond your level, you have thirty (30) days from the date it is exceeded to upgrade, and you will owe the difference in fees from that date. You are not in breach for growing within that period. Publishing Unmarked Output while materially misrepresenting your Audience voids the Media License, and any publication made without a valid Media License is unlicensed use of TempoQuest’s Output. No revenue audit. TempoQuest determines Audience from publicly displayed metrics on the channels where your Output appears. For outlets without publicly displayed metrics (such as websites), Audience is per your good-faith representation, and TempoQuest may rely on reputable third-party estimates. TempoQuest will not request, and you need not provide, revenue figures, financial statements, or access to books or accounts. Reserved — Television Broadcast. Television Broadcast requires a Media License (TV Broadcast) under a separate written agreement with TempoQuest. This requirement applies to Marked Output and Unmarked Output alike; the Attribution Mark does not authorize Television Broadcast. Contact TempoQuest before any Television Broadcast use. Reserved — resale and supply. Regardless of the Attribution Mark, you may not resell, syndicate, or sublicense the Data Services, supply the Data Services or bulk Output by feed, API, or file transfer, or incorporate them into another software product, data service, or visualization offering, without a separate written agreement with TempoQuest. Including Output within your own content, programming, or streams is governed by the Marked Output, Unmarked Output, and Television Broadcast provisions of this Section, not by this paragraph. Published Output survives. Output lawfully published while your subscription and any applicable Media License were active may remain published after they lapse or terminate. Lapse or termination ends the right to publish new Output; it does not require the removal of Output previously published in compliance with this Agreement. Attribution Mark integrity. The Software provides a setting to disable the Attribution Mark. Using that setting is permitted for internal and personal purposes. Removing, cropping out, obscuring, or altering the Attribution Mark and then publishing or distributing the result, without the applicable Media License, is a breach of this Agreement. Rights come from the Media License, not from the subscription tier. Purchasing additional seats or a higher-priced subscription tier does not by itself enlarge the rights granted by this Section; subscription tiers differ in data coverage, history depth, and delivery service. TempoQuest may include a Media License with a subscription tier, in which case the included rights are stated at the point of sale. Nothing in this Section limits Section 5. V0 is not recommended for agency usage. 5. No Operational Reliance (Pre-V1) WSV3 Tactical/WSV3 Studio V0 is a pre-operational release. Before Version 1.0: The Software and Data Services are not recommended for operational, safety-critical, or decision-critical use, including but not limited to aviation, marine operations, emergency management, public safety, or life-safety decisions. You assume all risk arising from any reliance on the Software or Data Services. 6. Disclaimer of Warranties THE SOFTWARE AND DATA SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPOQUEST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: Accuracy Completeness Timeliness Availability Fitness for a particular purpose Non-infringement Weather, geospatial, and real-time data are inherently uncertain and may be delayed, incomplete, corrupted, unavailable, or incorrect. 7. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW: TEMPOQUEST SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES INCLUDING loss of profits, loss of data, business interruption, or damages arising from reliance on the Software or Data Services THIS APPLIES EVEN IF TEMPOQUEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 8. Indemnification / Hold Harmless You agree to defend, indemnify, and hold harmless TempoQuest, Inc., its officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, or expenses arising from your use or misuse of the Software or Data Services, your reliance on any output, visualization, or derived product, and/or your violation of this Agreement. 9. V0 Data Availability & Refund Policy TempoQuest makes no guarantee of uptime or availability for Data Services and this Agreement creates no service-level agreement (SLA). However, during the V0 period only, if Data Services are Inaccessible due to TempoQuest systems for more than 20% of your applicable Billing Period, TempoQuest may, at its sole discretion, offer a partial or full refund or credit. All determinations of inaccessibility, availability, impact, and refund eligibility are made solely by TempoQuest and exclude Excluded Downtime (such as from government data outages). 10. No Guarantee of Continuity TempoQuest may modify, suspend, or discontinue any feature, data source, processing pipeline, pricing or licensing model, at any time, with or without notice. 11. Termination This license terminates automatically if you violate this Agreement. Upon termination, you must cease use of the Software and Data Services. 12. Governing Law This Agreement shall be governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. 13. Entire Agreement This Agreement constitutes the entire agreement between you and TempoQuest regarding WSV3 Tactical and WSV3 Studio and supersedes all prior agreements relating to this subject matter, except any separately executed written agreement between you and TempoQuest (including any Media License – TV Broadcast agreement), which controls over this Agreement in case of conflict. 14. Severability If any provision is found unenforceable, the remaining provisions remain in effect. 15. No Waiver Failure to enforce any provision is not a waiver. 16. Assignment; Survival You may not assign this Agreement. Sections 4–9 and 11–12 (and any provisions that by their nature should survive) survive termination. 17. Third-party open-source notices This product includes third-party open-source software components licensed under their respective licenses.
