WSV3 Tactical Mesoanalyst - V0 Pre-Operational Release End User License Agreement © 2025 TempoQuest, Inc. Windham, New Hampshire, USA By installing, accessing, or using WSV3 Tactical Mesoanalyst (“WSV3 Tactical”), you agree to the following terms. If you do not agree, do not install or use the software or data services. 1. Definitions Software: The WSV3 Tactical Mesoanalyst application and related binaries. Data Services: Any real-time, near-real-time, historical, processed, hosted, or redistributed data delivered by TempoQuest servers, whether paid or trial. User: The individual or entity using the Software or Data Services. Company: TempoQuest, Inc. Subscription Period / Billing Period: The paid period for which you are charged (e.g., monthly, annual, or other). Excluded Downtime: Scheduled maintenance, emergency maintenance, third-party outages (upstream providers, cloud/CDN/DNS), force majeure, data source outages, your network/ISP/VPN/firewall issues, misuse, or use outside supported configurations. Inaccessible / Inaccessibility: A failure of TempoQuest systems to authenticate or deliver Data Services to you when requested, excluding Excluded Downtime. 2. License Grant – Software The Software itself is provided free of charge and is licensed, not sold. You are granted a non-exclusive, non-transferable license to install and use the Software for lawful non-commerical purposes, subject to this Agreement. 3. Ownership; Restrictions TempoQuest retains all right, title, and interest in and to the Software and Data Services, including all intellectual property rights. Except as expressly permitted by this Agreement, you may not: (a) copy, reproduce, distribute, sell, lease, sublicense, or transfer the Software; (b) reverse engineer, decompile, disassemble, or attempt to derive source code; (c) bypass or circumvent access controls; (d) use the Software or Data Services to build or operate a competing product or service; (e) scrape, harvest, or bulk-download Data Services except as enabled by the Software’s normal operation; or (f) share credentials or access intended for a single user/seat with others. 4. Data Services License (Paid) Certain features of WSV3 Tactical require a paid data license. A paid data license grants you access to TempoQuest-hosted Data Services only for the active subscription period and only as delivered. No ownership or rights to the underlying data, infrastructure, or processing methods are conveyed. You may use Data Services only for your internal use (or your organization’s internal use), including non-commercial/personal social media/internet posting usage. For all profit-generating/broadcast/commercial usage, please contact us. V0 is not recommended for agency usage. 5. No Operational Reliance (Pre-V1) WSV3 Tactical Mesoanalyst V0 is a pre-operational release. Before Version 1.0: The Software and Data Services are not recommended for operational, safety-critical, or decision-critical use, including but not limited to aviation, marine operations, emergency management, public safety, or life-safety decisions. You assume all risk arising from any reliance on the Software or Data Services. 6. Disclaimer of Warranties THE SOFTWARE AND DATA SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEMPOQUEST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: Accuracy Completeness Timeliness Availability Fitness for a particular purpose Non-infringement Weather, geospatial, and real-time data are inherently uncertain and may be delayed, incomplete, corrupted, unavailable, or incorrect. 7. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW: TEMPOQUEST SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES INCLUDING loss of profits, loss of data, business interruption, or damages arising from reliance on the Software or Data Services THIS APPLIES EVEN IF TEMPOQUEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 8. Indemnification / Hold Harmless You agree to defend, indemnify, and hold harmless TempoQuest, Inc., its officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, or expenses arising from your use or misuse of the Software or Data Services, your reliance on any output, visualization, or derived product, and/or your violation of this Agreement. 9. V0 Data Availability & Refund Policy TempoQuest makes no guarantee of uptime or availability for Data Services and this Agreement creates no service-level agreement (SLA). However, during the V0 period only, if Data Services are Inaccessible due to TempoQuest systems for more than 20% of your applicable Billing Period, TempoQuest may, at its sole discretion, offer a partial or full refund or credit. All determinations of inaccessibility, availability, impact, and refund eligibility are made solely by TempoQuest and excludes Excluded Downtime (such as from government data outages). 10. No Guarantee of Continuity TempoQuest may modify, suspend, or discontinue any feature, data source, processing pipeline, pricing or licensing model, at any time, with or without notice. 11. Termination This license terminates automatically if you violate this Agreement. Upon termination, you must cease use of the Software and Data Services. 12. Governing Law This Agreement shall be governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. 13. Entire Agreement This Agreement constitutes the entire agreement between you and TempoQuest regarding WSV3 Tactical V0 and supersedes all prior agreements relating to this subject matter. 14. Severability If any provision is found unenforceable, the remaining provisions remain in effect. 15. No Waiver Failure to enforce any provision is not a waiver. 16. Assignment; Survival You may not assign this Agreement. Sections 4–9 and 11–12 (and any provisions that by their nature should survive) survive termination. 17. Third-party open-source notices This product includes third-party open-source software components licensed under their respective licenses.
